TERMS AND CONDITIONS OF THE MODE LIBRE ONLINE STORE

These Terms and Conditions set out the rules governing the use of the MODE LIBRE online store, placing orders, concluding sales contracts, payments, delivery, and the basic rights and obligations of the Customer and MODE LIBRE.

By making a purchase from MODE LIBRE, the Customer should read these Terms and Conditions as well as the information relating to the specific product before placing an order.

MODE LIBRE is a business registered in Belgium.

2. Online Store

MODE LIBRE sells products online, in particular second-hand, vintage and pre-owned luxury products such as handbags, accessories, jewellery, clothing and footwear.

Products available in the store may be individual, unique pieces.

The store operates using the Shopify platform.

3. Vintage and Pre-Owned Products

Unless otherwise stated in the description of a particular product, products offered by MODE LIBRE are second-hand, vintage or pre-owned products.

Due to their nature, they may show signs of previous use and age, including scratches, discolouration, patina, signs of wear on hardware, natural wear of leather or fabric, and other individual characteristics.

MODE LIBRE makes reasonable efforts to describe each product individually and accurately and to present known material signs of use and the condition of the product in the description and/or photographs.

Before purchasing, the Customer should carefully review the description, photographs, measurements and information concerning the condition of the specific product.

4. Product Information

MODE LIBRE provides the main characteristics of each product on the relevant product page, to the extent appropriate for that product.

Photographs form part of the product presentation. Due to screen settings, lighting used when photographs are taken or the characteristics of particular materials, the actual colour of a product may differ slightly from the colour displayed on the screen.

Information concerning the condition of second-hand products is provided taking into account their nature, age and previous use.

Nothing in this section limits the consumer's statutory rights concerning the conformity of goods with the contract.

5. Prices

Product prices are displayed in the currency shown in the online store.

Before placing an order, the Customer is informed of the total price of the order and any additional costs, in particular delivery costs, where applicable.

Delivery costs are displayed before the Customer finally places the order.

MODE LIBRE may change product prices. A price change does not affect orders for which a sales contract has already been concluded.

Where promotions or price reductions are offered, MODE LIBRE applies the applicable rules concerning the communication of price reductions.

6. Placing an Order

The Customer selects a product and, where applicable, its available options, adds it to the shopping cart and proceeds through the checkout process.

Before finally placing the order, the Customer has the opportunity to review the basic order information and correct any errors.

The Customer should provide accurate and complete information necessary to process the order.

An order requiring payment is placed by using a button or equivalent function that clearly informs the Customer that placing the order entails an obligation to pay.

7. Conclusion of the Contract

After the order has been placed, MODE LIBRE sends an order confirmation to the email address provided by the Customer.

The sales contract is concluded in accordance with the information presented to the Customer during the ordering process and the applicable law.

The order confirmation contains or provides access to information concerning the transaction in accordance with applicable law.

MODE LIBRE may contact the Customer if clarification of the information provided is necessary to process the order.

8. Product Availability

Many MODE LIBRE products are individual, one-of-a-kind items.

Adding a product to the shopping cart does not necessarily reserve the product until the checkout process has been successfully completed.

If, in exceptional circumstances, a product becomes unavailable after an order has been placed, MODE LIBRE will promptly inform the Customer and refund any payment already received.

9. Payments

Available payment methods are displayed to the Customer during checkout.

Electronic payments may be processed by external payment service providers available through the online store.

Where payment by traditional bank transfer is selected, the order will be processed after the payment has been credited to the bank account.

10. Order Processing

MODE LIBRE prepares orders for dispatch within 24 hours of order confirmation and receipt of payment, on business days.

Orders placed on weekends or Belgian public holidays are prepared for dispatch on the next business day.

11. Delivery

Products are shipped from Belgium to the address provided by the Customer during checkout.

MODE LIBRE uses, in particular, DPD courier services.

The estimated delivery time is generally 2–5 business days from the date of dispatch, depending on the destination country and the carrier's operations.

The stated delivery time is an estimate unless a binding delivery date has been expressly agreed for a particular order.

After dispatch, the Customer will receive a shipping confirmation and, where available, a tracking number.

12. Delivery Costs

For deliveries to Poland:

For orders with a value below PLN 1,000, the delivery cost is PLN 25.

For orders with a value of PLN 1,000 or more, delivery is free of charge.

Delivery to other selected European countries may be available under the conditions and at the price displayed during checkout.

Delivery restrictions and available payment methods are presented to the Customer during the ordering process.

13. Responsibility for Shipments

For sales to consumers, MODE LIBRE bears the risk relating to the shipment until the Customer or a third party designated by the Customer, other than the carrier, physically receives the product, subject to the exceptions provided by applicable law.

14. Right of Withdrawal

A Customer who is a consumer generally has the right to withdraw from a distance contract within 14 calendar days without giving any reason, subject to the exceptions provided by applicable law.

MODE LIBRE also provides a model withdrawal form.

Nothing in these Terms and Conditions limits the consumer's statutory right of withdrawal.

15. Cost of Returning a Product Following Withdrawal

The direct cost of returning a product when exercising the right of withdrawal is borne by the Customer, unless MODE LIBRE informs the Customer otherwise or applicable law provides otherwise.

The Customer should be informed of this cost before the contract is concluded.

16. Statutory Guarantee of Conformity

Products sold to consumers are covered by the statutory guarantee of conformity.

For second-hand products, the statutory guarantee period may be reduced to 1 year from delivery of the product, provided that this reduction has been clearly and unambiguously agreed with the Customer before purchase.

If the reduction has not been validly agreed, the statutory 2-year period applies.

For second-hand products sold by MODE LIBRE, the reduction of the statutory guarantee period to 1 year applies only where it has been properly agreed with the Customer before the conclusion of the contract.

17. Complaints

If the Customer discovers that a product does not conform to the contract, the Customer may contact MODE LIBRE at:

To facilitate the handling of a complaint, the Customer may provide the order number, product name, a description of the problem and, where helpful, photographs.

Failure to provide photographs does not in itself deprive the Customer of their statutory rights.

In accordance with the applicable Belgian rules, the consumer should notify the Seller of the discovered lack of conformity as soon as possible and, in any event, within 2 months of discovering it.

18. Rights in the Event of Lack of Conformity

If a product does not conform to the contract, the consumer is entitled to the remedies provided by applicable law.

Depending on the circumstances, these may include repair or replacement and, where the relevant legal conditions are met, a price reduction or termination of the contract and the corresponding refund.

In the case of a unique vintage product, replacement with an identical item may be impossible. This does not limit the consumer's other statutory rights.

Responsibility under the statutory guarantee remains with the Seller.

19. Personal Data Protection

Customers' personal data is processed in accordance with applicable data protection legislation, including the GDPR.

Information concerning cookies is available in the COOKIE POLICY and through the cookie preference settings available in the online store.

20. Intellectual Property

Content created by MODE LIBRE and made available through the online store, including its own photographs, texts, descriptions and graphic elements, may be protected by intellectual property rights.

Such content may not be used in a manner that infringes the rights of MODE LIBRE or third parties.

Trademarks and brand names belong to their respective owners.

21. Liability

MODE LIBRE is liable towards consumers to the extent required by mandatory applicable law.

Nothing in these Terms and Conditions excludes or limits any consumer rights that cannot legally be excluded or restricted by contract.

22. Applicable Law

These Terms and Conditions and sales contracts concluded with MODE LIBRE are governed by Belgian law, subject to mandatory provisions of consumer protection law.

Where MODE LIBRE directs its commercial activities to the country in which a consumer has their habitual residence, the choice of Belgian law does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence that would apply in the absence of such a choice of law.

23. Complaints and Dispute Resolution

In the event of a problem concerning an order, the Customer should first contact MODE LIBRE at:

The parties may attempt to resolve the dispute amicably.

Where the applicable conditions are met, a consumer may also contact an appropriate authority or alternative consumer dispute resolution body.

24. Changes to These Terms and Conditions

MODE LIBRE may update these Terms and Conditions, in particular as a result of changes in applicable law, the operation of the online store or the services offered.

Changes do not affect rights arising from contracts concluded before the updated Terms and Conditions enter into force.
